1. Acceptance of Terms
Welcome to Titan Core. By accessing our website, requesting our services, or entering into an agreement with us, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website or services.
These Terms apply to all visitors, users, and others who access or use our services. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of our services constitutes acceptance of any changes.
2. Services Provided
Titan Core provides construction and remodeling services, including but not limited to:
- Kitchen remodeling and renovation
- Porcelain tile installation
- Floor leveling and preparation
- Framing and drywall services
- Interior painting
- Related construction and remodeling services
Specific services, timelines, costs, and deliverables will be outlined in individual service agreements or contracts executed between Titan Core and the client.
3. Quotes and Estimates
Free quotes and estimates provided by Titan Core are preliminary assessments based on the information available at the time. Final pricing may vary based on:
- Actual site conditions discovered during the project
- Changes in material costs or availability
- Modifications to project scope requested by the client
- Unforeseen complications or structural issues
Quotes are valid for 30 days from the date of issue unless otherwise specified. Any changes to pricing will be communicated to the client for approval before proceeding.
4. Service Agreements
Upon acceptance of a quote, a formal service agreement or contract will be executed. This agreement will include:
- Detailed scope of work
- Project timeline and milestones
- Payment terms and schedule
- Materials and specifications
- Change order procedures
- Warranty information
- Cancellation and termination terms
Both parties must sign the service agreement before work commences. The service agreement supersedes any prior verbal or written communications regarding the project.
5. Payment Terms
Payment terms will be specified in your service agreement. Generally:
- A deposit may be required before work begins
- Progress payments may be due at specified project milestones
- Final payment is due upon project completion and client approval
- Late payments may be subject to interest charges
- Work may be suspended if payments are not received as scheduled
Accepted payment methods will be specified in your service agreement. All payments are in U.S. dollars.
6. Client Responsibilities
Clients agree to:
- Provide accurate information about the project and property
- Obtain necessary permits and approvals (unless otherwise agreed)
- Ensure access to the work site during scheduled work hours
- Protect or remove valuable items from work areas
- Make timely decisions on selections and change orders
- Provide timely payment according to the agreed schedule
- Notify us of any concerns or issues promptly
7. Changes and Modifications
Any changes to the scope of work must be requested in writing and approved by both parties through a formal change order. Change orders may affect:
- Project timeline
- Total cost
- Materials and specifications
- Payment schedule
Work will not proceed on changes until a signed change order is executed and any required additional deposit is received.
8. Warranties
Titan Core warrants that all work will be performed in a professional and workmanlike manner in accordance with industry standards. Specific warranty terms will be outlined in your service agreement and may include:
- Workmanship warranty period
- Material warranties (as provided by manufacturers)
- Exclusions and limitations
- Maintenance requirements
Warranties do not cover damage resulting from normal wear and tear, misuse, lack of proper maintenance, alterations by others, or events beyond our control.
9. Limitation of Liability
To the fullest extent permitted by law, Titan Core's liability for any claims arising from our services shall be limited to the amount paid by the client for the specific services giving rise to the claim. We shall not be liable for:
- Indirect, incidental, special, or consequential damages
- Loss of profits, revenue, or business opportunities
- Property damage not caused by our negligence
- Delays caused by factors beyond our reasonable control
- Issues arising from pre-existing conditions not disclosed or discoverable
10. Insurance and Licensing
Titan Core maintains appropriate licenses and insurance coverage as required by law, including general liability insurance and workers' compensation coverage for our employees. Proof of insurance and licensing can be provided upon request.
11. Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of Titan Core or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.
We may use photographs of completed projects for marketing purposes unless otherwise agreed in writing. Client names and identifying information will not be used without permission.
12. Dispute Resolution
In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, the parties may pursue mediation before initiating formal legal proceedings.
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of law provisions. Any legal action must be brought in the courts located in Cook County, Illinois.
13. Force Majeure
Titan Core shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, labor disputes, material shortages, or government actions.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Terms, together with any service agreement or contract executed between Titan Core and the client, constitute the entire agreement between the parties and supersede all prior communications, agreements, and understandings, whether written or oral.
